These Terms of Service (“Terms”) form a legally binding agreement between you (“Customer”, “Buyer”, “you”) and OSHONIC (“Oshonic”, “we”, “us”, “our”). These Terms govern your access to and use of oshonic.com.au and any purchase of products supplied by Oshonic.
By accessing our website, placing an order, or purchasing any product, you acknowledge that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, you must not use our website or purchase our products.
1. Legal Capacity and Acceptance
By using this website or placing an order, you confirm that:
- You are at least 18 years of age or have legal capacity to enter a binding contract;
- All information you provide is accurate and complete;
- You are purchasing for lawful purposes only;
- You accept responsibility for all activity under your account.
Oshonic reserves the absolute right, at its sole discretion, to refuse service, reject orders, suspend accounts, or cancel transactions without liability where we suspect fraud, misuse, breach of these Terms, or unlawful conduct.
2. Product Scope and Category Separation
2.1 Bathroom Products
Bathroom products include smart toilets and related accessories. These products are intended for installation in accordance with applicable Australian standards and licensed trade requirements.
2.2 Living Products (Wholesale Only)
Living products, including Australian made mattresses, bed bases, headboards and gas lift storage beds, are supplied strictly to approved trade customers unless otherwise stated in writing by Oshonic.
End-users purchasing Living products through a retailer or trade account must direct all product and warranty enquiries to the supplying retailer unless Australian Consumer Law requires otherwise.
3. Product Information and Accuracy
All product descriptions, images, specifications, dimensions and technical data are provided in good faith. However:
- Specifications may change without notice;
- Images are illustrative and may differ slightly from the supplied product;
- Colour, finish and minor design variations may occur;
- Website content may contain inadvertent errors.
Customers are solely responsible for verifying suitability, compatibility, space requirements, plumbing configuration, and electrical requirements before purchase.
Oshonic makes no guarantee that website content is error-free, complete, or current.
4. Orders, Pricing and Payment
4.1 Order Acceptance
An order constitutes an offer by you to purchase. A contract is formed only when payment is processed and Oshonic issues written confirmation.
Oshonic may cancel any order at its discretion, including due to:
- Stock errors or shortages;
- Pricing errors;
- Fraud suspicion;
- Payment verification issues;
- Delivery restrictions.
4.2 Pricing
All prices are in AUD and include GST unless stated otherwise. Oshonic may amend pricing at any time prior to order confirmation.
If a pricing error occurs, Oshonic may cancel the order and refund payment without further liability.
4.3 Payment Responsibility
You warrant that you are authorised to use the payment method provided and that funds are available. Oshonic is not liable for unauthorised transactions caused by compromised credentials or user negligence.
5. Installation and Site Responsibility
5.1 Mandatory Professional Installation (Bathroom)
Smart toilets and relevant bathroom products must be installed by appropriately licensed trades in accordance with manufacturer instructions and applicable standards.
Improper installation may void warranty and may create safety risks. Oshonic accepts no liability for damage, injury, or non-compliance resulting from improper installation.
5.2 Pre-Installation Verification
Customers and installers must verify:
- Water pressure and plumbing compatibility;
- Electrical suitability where applicable;
- Dimensions and clearance requirements;
- Compliance with local regulations.
Products that have been installed, modified, or connected cannot be returned except as required by Australian Consumer Law.
6. Shipping and Delivery
Delivery timeframes are estimates only. Oshonic is not liable for delays caused by carriers, supply constraints, weather, public holidays, or events beyond our control.
You must inspect goods immediately upon delivery and report visible damage within 48 hours. Failure to do so may result in rejection of claims.
Incorrect delivery details, refusal of delivery, or site inaccessibility may incur additional charges.
7. Warranty Reference
Warranty terms are governed by Oshonic’s separate Warranty Information page and product-specific documentation. Warranty periods vary by product and component.
Nothing in these Terms extends warranty coverage beyond what is expressly stated for the relevant product.
8. Limitation of Liability
To the maximum extent permitted by law, Oshonic’s total liability for any claim is strictly limited to the purchase price paid for the specific product giving rise to the claim.
Oshonic excludes liability for:
- Indirect, consequential, incidental or special damages;
- Loss of profits, revenue or opportunity;
- Installation, removal or labour costs;
- Project delays or third-party contractor costs;
- Property damage caused by incorrect installation or misuse;
- Compatibility issues not verified prior to purchase.
9. Intellectual Property
All website content, branding, design elements, and product materials are owned by Oshonic or licensed to Oshonic.
You may not reproduce, copy, distribute, scrape, modify or commercially exploit any content without prior written consent.
10. Indemnity
You agree to indemnify and hold harmless Oshonic, its directors, officers and affiliates against all claims, losses, damages, liabilities and legal costs arising from:
- Your breach of these Terms;
- Improper installation or misuse of products;
- Your violation of any law or third-party rights;
- Your negligence or wrongful conduct.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies rights that cannot lawfully be excluded under the Australian Consumer Law.
Where consumer guarantees apply, Oshonic will comply strictly with statutory obligations and no more than required by law.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.
13. Amendments
Oshonic may update these Terms at any time. The version in effect at the time of purchase governs that transaction.
